Non-profits and Public Institutions

Associations and non-profits

The firm has extensive experience with non-profit organizations and public benefit companies (PBC). In this area, the firm’s team supports prominent entities in the Israeli economy, as well as smaller non-profit associations traditionally belonging to the third sector, including in theater and arts, education and welfare, human rights, sports, and more.

Our team provides ongoing advice to these various entities, including regulatory procedures and financing methods such as government grants, budgets, donations, self-generated income and friends’ associations. We also advise the management of these bodies, particularly regarding the connection between their activities as a non-profit public institution and the business world in which they operate.

Establishment and support of associations – The firm handles the establishment of associations and public benefit companies, drafts unique bylaws for these entities, and provides advice from the initial setup stage regarding the desired mode of operation, establishment of various institutions, and formulation of rules for financial management and procedures to ensure the issuance of proper management approval.

Specialization in specific fields of practice – Our team has specific expertise in issues relating to the arts, education, and welfare, and regularly advises associations and organizations engaged in these fields, including guidance regarding new legal provisions (for example, the Sheltered Housing Law), and non-standard contractual agreements.

Large public benefit companies and non-profit associations – We provide ongoing advice to particularly large non-profit associations, whose financial activity amounts to tens and hundreds of millions of shekels annually. Some of these non-profit associations are also subject to administrative law, tenders laws and additional regulation.

Statutory and quasi-statutory corporations – The firm advises bodies whose activities are of a public nature and often subject to the provisions of administrative law. This includes ongoing advice, including for contractual agreements (generally within the framework of tender laws), as well as in administrative and civil litigation.

Support for social organizations – Our team offers legal advice to various social organizations at a significantly reduced rate and as part of our pro bono activities. More often than not, the firm’s employees take on senior positions in organizations and associations, including as chairpersons, board members, etc. More on this subject can be found on the firm’s public activity.

Educational Institutions

Our firm represents various academic institutions and forums in this field, providing legal counsel in dealings with relevant authorities (the Council for Higher Education, the Ministry of Education, the Ministry of Culture, etc.) across all areas of their activity.

Ongoing advisory services to the institution’s management in corporate governance matters – Ensuring compliance with the directives of the Council for Higher Education, regulatory authorities, and other relevant bodies, as well as drafting internal policies, bylaws, and guidelines in accordance with legal and regulatory requirements.

Support in all aspects of academic procedures – Including admission processes, disciplinary committees and appeals, and termination of studies.

Representation in litigation – Handling administrative and public law cases, tenders, civil-commercial litigation, and labor law disputes, including negotiations with faculty and administrative staff unions.

Commercial legal advice – Related to the academic and higher education sector, including intellectual property rights, protecting institutional (as well as faculty and student) rights, and addressing all legal aspects of rights creation, transfer, distribution, and use.
